FRUSTRATED KILLING, FORCED DISAPPEARANCE

1.    Nilo Arado, 39 years old, married, regional coordinator of    Anakpawis partylist, chairman of the Bagong Alyansang Makabayan, national council member of Kilusang Magbubukid ng Pilipinas, resident of Brgy. Patlad, Dumangas, Iloilo; and

 

2.    Maria Luisa Posa Dominado, 52 years old, member of Samahan ng mga Ex-Detainees Laban sa Detensiyon at para sa Amnestiya, resident of Delgado St., Iloilo City

 

Wounded:

Jose Ely Garachico, 50 years old, married, vice-chairperson of Panay Alliance-Karapatan, resident of Brgy. Dulonan, Arevalo, Iloilo City

Perpetrators: Unidentified members of the military

On April 12, 2007, at around 9:00 in the evening, Arado and Dominado on a Mitsubishi pick-up truck driven by Garachico traveling from San Jose, Antique When they were at Brgy., Cabanbanan, Oton Iloilo, a green Mitsubishi Delica Van with plate number FVF 463 overtook them and suddenly stopped, forcing Garachico to stop suddenly behind the Delica Van.

 

Immediately, two men wearing fatigue shorts and t-shirts, got off from each side of the van, pointed machine pistols at the pick-up truck and shouted at the occupants to get out while they approached.

 

Almost simultaneously, the man on the right side smashed the front window of the pick-up truck and the men on the left fired a shot at Garachico, hitting him on the neck. He pulled Garachico from the driver’s seat but the seat belt constrained him. Garachico loosened the seat belt and got off the vehicle. The man pushed Garachico towards the van but Garachico resisted by holding on to the rear of the vehicle, while expecting to be shot again.

 

Garachico felt the pushing stop and suddenly the pick-up truck and the two vehicles sped away taking Arado and Dominado with them, leaving behind Garachico standing in the middle of the road.

 

Witnesses claimed that Dominado was dragged into the green Mitsubishi Delica Van while Arado was forced into a maroon Starex vehicle with plate numbers GEW or GEM 874 or 847. A third man boarded Garachico’s pick-up truck and sped away along with the Mitsubishi van and the Starex.

 

Dominado was wearing a white blouse and black pants while Arado was wearing a brown checkered polo shirt and maong pants.

 

Barangay residents helped Garachico, taking him to the house of Punong Barangay Eduardo Erecre just along the road. They brought him to the Oton Police Station where he was immediately put in an ambulance and brought to the Iloilo Doctors’ Hospital for treatment.

 

The bullet entered his lower left neck and lodged inside his left lung.

 

The Oton Police Station investigated the incident but Garachico was unable to provide positive identification of the perpetrators since the incident happened swiftly. A searched in the road failed to locate the missing persons and vehicle.

 

In the morning of April 13, Garachico’s pick-up truck was found at Guadalupe, Janiuay, Iloilo, badly burned.

 

The Regional Police sent operatives from the Criminal Investigtion and Detection Group to interview Garachico in an effort to investigate the case. The Department of Justice, through Prosecutor Laurea, also came to visit Garachico to look at the possibilities of filing a case.
